These Terms of Use ("Terms") govern your access to and use of the ChatThis.ai website at chatthis.ai and all related services (collectively, the "Service") provided by ChatThis.ai ("ChatThis," "we," "us," or "our"). By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.
1. Description of Service
ChatThis.ai is a platform that allows content creators to transform their content (videos, blog posts, podcasts, social media posts, PDFs, and other text) into AI-powered chatbots with goal-driven conversations. The Service includes chatbot creation, Smart Link generation, conversation management, conversion tracking, and related features as described on our website.
2. Account Registration
To use certain features of the Service, you must create an account. You agree to:
— Provide accurate, current, and complete information during registration.
— Maintain the security of your account credentials.
— Promptly update your information if it changes.
— Accept responsibility for all activity that occurs under your account.
You must be at least 16 years old to create an account. If you are under 18, you represent that you have your parent's or guardian's permission to use the Service.
3. Subscription and Payments
The Service offers both free and paid subscription plans. By subscribing to a paid plan, you agree to pay all applicable fees as described on our pricing page.
— Billing occurs monthly on the anniversary of your subscription start date.
— All fees are non-refundable except as required by applicable law.
— We may change pricing with 30 days' advance notice. Continued use after a price change constitutes acceptance.
— If payment fails, we may suspend or downgrade your account after a reasonable grace period.
— New accounts receive a 14-day reverse trial with full Pro features, after which the account is automatically downgraded to the Free plan unless upgraded.
4. Acceptable Use
You agree not to use the Service to:
— Violate any applicable law, regulation, or third-party rights.
— Upload or process content you do not have the right to use.
— Create chatbots that impersonate other individuals without their consent.
— Generate or distribute misleading, fraudulent, or harmful content.
— Attempt to gain unauthorized access to the Service or its systems.
— Interfere with or disrupt the Service or servers.
— Use the Service for spamming or unsolicited messaging.
— Reverse engineer, decompile, or disassemble any part of the Service.
We reserve the right to suspend or terminate accounts that violate these rules.
5. Intellectual Property
The Service, including its design, code, features, documentation, and branding, is owned by ChatThis.ai and protected by intellectual property laws. You may not copy, modify, distribute, or create derivative works of the Service without our prior written consent. Your use of the Service does not grant you any ownership rights in the Service or its underlying technology.
6. Your Content
You retain ownership of all content you upload to or create through the Service. By uploading content, you grant ChatThis.ai a limited, non-exclusive license to process, store, and display your content solely for the purpose of providing the Service to you. You represent that you have the right to use and upload all content you provide, and that your content does not infringe any third party's intellectual property or other rights.
7. Visitor Interactions
Visitors who interact with your chatbot via Smart Links are not required to create an account with ChatThis.ai. You are responsible for how you use the data collected through your chatbot conversations, including compliance with applicable privacy laws and regulations. You agree to maintain your own privacy policy that accurately describes your data collection and use practices.
8. Disclaimer of Warranties
The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or secure. AI-generated responses may contain inaccuracies. You acknowledge that AI-powered conversations may not always be perfectly accurate and agree to review important outputs.
9. Limitation of Liability
To the maximum extent permitted by law, ChatThis.ai shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or business opportunities, arising from your use of or inability to use the Service. Our total liability for any claims arising from the Service shall not exceed the amount you paid us in the 12 months preceding the claim.
10. Termination
You may terminate your account at any time by contacting us or through your account settings. We may suspend or terminate your account at any time if you violate these Terms, engage in abusive behavior, or for any other reason at our discretion with reasonable notice. Upon termination, your right to use the Service ceases immediately. We will delete your data within 30 days of account termination, except where retention is required by law.
11. Governing Law
These Terms shall be governed by and construed in accordance with the laws of Poland, without regard to its conflict of law provisions. Any disputes arising from these Terms or the Service shall be resolved in the courts of Poland.
12. Changes to These Terms
We may update these Terms from time to time. We will notify you of material changes by posting the updated Terms on this page and updating the "Last updated" date. Your continued use of the Service after changes are posted constitutes acceptance of the revised Terms. If you do not agree to the updated Terms, you must stop using the Service.
